2. Nature of Sales and Condition of Works

Del Amo Art Gallery offers fine art for private acquisition, including works in painting, drawing, photography, illustration, and sculpture, with a specialization in Latin American and Cuban modernism. All works are offered and sold in their present condition at the time of sale.

While Del Amo Art Gallery makes every reasonable effort to accurately describe the condition, attribution, and provenance of each work, these descriptions are provided in good faith and do not constitute a warranty of condition. Photographic representations are provided to assist the buyer but may differ from the physical work due to screen calibration, lighting, and reproduction limitations.

Prospective buyers are strongly encouraged to request a full condition report, provenance documentation, and, where applicable, a certificate of authenticity prior to completing an acquisition. Del Amo Art Gallery will provide all available documentation upon request.

For works with valuations above $25,000, we recommend an independent conservation inspection before purchase.

3. Authenticity, Provenance, and Attribution

Del Amo Art Gallery curates works with verified provenance and, where available, certificates of authenticity from recognized artist representatives, estates, or scholarly authorities. All provenance information disclosed in listings is based on documentation available at the time of sale.

Attribution is provided based on the best available scholarly and physical evidence. In cases of uncertain attribution, the listing will expressly state the applicable qualifier (e.g., “Attributed to,” “Circle of,” or “Follower of”). Del Amo Art Gallery does not independently guarantee the attribution of works beyond the documentation provided.

If a work is later determined to be incorrectly attributed or inauthentic based on credible scholarly evidence not available at the time of sale, the buyer should contact Del Amo Art Gallery at info@delamoart.com to discuss the matter in good faith. Resolution will be evaluated on a case-by-case basis in accordance with applicable law.

4. Pricing and Payment

All prices listed on delamoart.com are in United States Dollars (USD) and represent the purchase price of the work exclusive of applicable taxes, shipping, and handling. Prices are subject to change without notice and do not constitute a binding offer until confirmed in writing by Del Amo Art Gallery.

Applicable Florida state and local sales taxes will be applied in accordance with Florida law, based on the buyer’s delivery address. International buyers are solely responsible for any customs duties, import taxes, VAT, or other levies imposed by their country of residence.

Payment must be received and cleared in full before any work is released for shipping or transfer. Accepted payment methods are listed at checkout. For high-value acquisitions or private transactions, alternative payment arrangements may be coordinated directly through marcos@delamoart.com.

5. Shipping, Logistics, and Transfer of Risk

All shipping, packing, insurance, and handling costs are the sole responsibility of the buyer and are invoiced separately from the purchase price. No work will be released until all outstanding charges, including shipping, have been paid in full.

•        Domestic deliveries (United States): 5–10 business days standard; 2–3 business days express.

•        International deliveries: 7–21 business days depending on destination and customs processing.

•        All international buyers are responsible for customs duties, brokerage fees, import taxes, and regulatory compliance in their country.

Del Amo Art Gallery’s liability terminates upon transfer of the work to the designated carrier. Del Amo Art Gallery is not responsible for damage, loss, or delay occurring while the work is in transit. All claims for damage or loss must be directed to the carrier and insurance provider within 48 hours of receipt.

6. Self-Arranged Shipping and Collection

Buyers may arrange their own shipping or request local collection. Del Amo Art Gallery must be notified at least 48 hours in advance. The buyer or their authorized agent must present valid government-issued identification and a signed release authorization upon collection. Del Amo Art Gallery reserves the right to decline release of any work to an unverified party.

7. Returns, Cancellations, and Dispute Resolution

All sales are final upon written confirmation by Del Amo Art Gallery. Returns or cancellations will only be considered in the following circumstances:

•        The work is materially different from its description in a manner that was not disclosed at the time of sale.

•        A work is determined to be inauthentic on the basis of credible scholarly or forensic evidence unavailable at the time of purchase.

Return requests must be submitted in writing to info@delamoart.com within 14 days of receipt of the work. Del Amo Art Gallery will evaluate each request in good faith. Approved returns must be shipped in their original packaging, with equivalent insurance coverage, at the buyer’s expense. Refunds, where approved, will be issued for the hammer price or purchase price only and will exclude shipping, handling, and any non-refundable payment processing fees.

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful within 30 days, disputes shall be submitted to mediation before any litigation is initiated, in accordance with the governing law set forth in Section 10 below.

8. Intellectual Property

All content on delamoart.com — including but not limited to artwork images, photographs, catalog text, artist biographies, curatorial essays, and the Del Amo Art Gallery name, logo, and visual identity — is the exclusive property of Del Amo Art Gallery LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property law.

Physical ownership of a work of art does not transfer copyright in the work or its image to the buyer. Reproduction, distribution, public display, or commercial use of any artwork image or gallery content without the prior written consent of Del Amo Art Gallery LLC and, where applicable, the artist or estate, is strictly prohibited.

Limited personal and non-commercial use of content (e.g., sharing a listing for personal reference) is permitted provided that attribution to Del Amo Art Gallery is clearly maintained and no modification of the content is made.

9. Privacy and Data Use

Del Amo Art Gallery collects and processes personal information in connection with acquisition inquiries, purchases, and website use in accordance with our Privacy Policy [LINK] and applicable Florida and federal privacy law. Information submitted through this website may be shared with Shopify Inc. as our e-commerce platform provider, and with third-party service providers (shipping, payment processing) strictly as necessary to fulfill orders and provide Services.

Del Amo Art Gallery does not sell or rent personal information to third parties for marketing purposes. Collector identity and acquisition records are treated with the highest level of confidentiality and will not be disclosed without the collector’s express consent, except as required by law.

10. Governing Law and Jurisdiction

This Legal Notice and all transactions conducted through delamoart.com are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these terms or from a transaction with Del Amo Art Gallery that cannot be resolved through negotiation or mediation shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. Both parties consent to personal jurisdiction in such courts.

Continued use of the website following any update constitutes acceptance of the revised terms. 12. Limitation of Liability

To the fullest extent permitted by applicable law, Del Amo Art Gallery LLC, its members, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website or any transaction conducted through it, even if Del Amo Art Gallery has been advised of the possibility of such damages. Del Amo Art Gallery’s total liability to any buyer shall not exceed the purchase price paid for the specific work giving rise to the claim.
